These Terms apply to anyone using Thoth's services. "We", "us", and "Thoth" mean the business operated by Tom in Australia. "You" means the person or organisation purchasing the service.
1. Who we are
Thoth is a small Australian hosting and software-services business. We operate under our registered ABN and Australian Consumer Law applies in addition to anything in this document.
2. The services
We offer four services described on the products page:
- Hosting — shared cPanel hosting with SSL and daily backups.
- Managed — Hosting plus proactive maintenance, monitoring and small content support.
- Enterprise — VPS infrastructure with a written Service Level Agreement, scoped per client.
- Pro Services — ad-hoc consulting and development at an hourly rate.
What's included in each service is described on the products page and, for Enterprise clients, in your signed agreement. If there's a conflict, the signed agreement wins.
3. Payment & renewal
Hosting and Managed are billed monthly in advance, with no minimum term beyond the current month. Enterprise billing is set out in your agreement. Pro Services are billed in arrears, with a two-hour minimum per engagement.
If a payment is missed, we'll send a reminder before doing anything else. Services may be suspended after 14 days overdue, and terminated after 30, with reasonable written notice in both cases.
4. Uptime & SLA
We aim for high availability across all tiers, but only Enterprise clients receive a written, financially-backed Service Level Agreement. Hosting and Managed are best-effort.
If something is broken, contact hello@thoth.au. Response times for non-SLA clients are usually one business day.
5. Your content
You own what you publish through Thoth. We don't claim any rights to it. You're responsible for making sure you have the right to use it, and that it doesn't break the law or our Acceptable Use Policy.
We keep daily backups of your site as part of Hosting and Managed, retained for 14 days. Backups are a safety net — please keep your own copies of anything irreplaceable.
6. Suspension & termination
We may suspend or terminate service if you breach these Terms or the Acceptable Use Policy, or for repeated non-payment. Where possible we'll always reach out first.
You can cancel any time with reasonable notice (a week is plenty for monthly plans). On termination we'll provide an export of your data and assist with handover within reason.
7. Liability
Nothing here limits any rights you have under Australian Consumer Law. Beyond those rights, our liability for any service-related claim is limited to the fees paid in the three months before the claim arose. We don't accept liability for indirect or consequential losses.
8. Changes to these terms
We may update these Terms occasionally. If we change something meaningful, we'll email you at least 30 days in advance. The current version is always at this URL, with the "Last updated" date above.
9. Governing law
These Terms are governed by the laws of Australia. Disputes will be heard in the courts of the state in which Thoth is registered.
Plain-English summary: pay your bill, don't host anything illegal, give a week's notice if you're leaving, and we'll do the same. Questions: hello@thoth.au.
